Обычно на эту должность берут россиян и дают им визу J1, H1. Весь такс им возвращают обратно. Как будет если человек имеет ГКард?

Если жил в США меньше полугода, то не платит налогов. Если больше, то платит.

Vse imenno tak i obstoit.
Odnako, vse zavisit ot togo, kakoi vy oformite tax return - resident ili nonresident.

Esli vy hotite sohranit' GC, to doljny oformit' resident tax return, i v etom sluchae u vas net tax exemptions dlia rossian.

Esli vas ne interesuet sud'ba GC, i vy ne boites' immigracionnyh posledstvii, to vy mojete oformit' nonresident return, i poluchit' tax exemption ot federal'nogo naloga. V etom sluchae vy v moment podpisania deklaracii utrachivaete GC i stanovites' nelegalom so vsemy vytekaiuscimi posledstviami - deportable za nelegal'nuiu rabotu i za nelegal'noe prebyvanie v strane.
Vy, bezuslovno, vprave postupit' tak i vospol'zovat'sia exemption dlia rossian.

Na samom dele est' i drugoi variant. Vy mojete podat' na INS v sud, i trebovat' vosstanovlenia GC. Na tom osnovanii, chto vy zapolnili nonresident tax return, smoshennichav. V etom sluchae vash zapolnennyi tax return nedeistvitelen, i vasha GC ostaetsia valid. Do teh por, poka sud ne vyneset v otnoshenii vas verdikt - chto vy vinovny v moshennichestve s cel'iu tax evasion. V etot moment vy opiat' je stanovites' deportable, i posle otbyvania ugolovnogo nakazania za tax evasion budete deportirovany i lisheny GC.

Effect of Claim to Nonresident Alien Status for Federal Income Tax Purposes:
An alien who has actually established residence in the United States after having been admitted as an immigrant or after having adjusted status to that of an immigrant, and who is considering the filing of a nonresident alien tax return or the non-filing of a tax return on the ground that he is a nonresident alien, should consider carefully the consequences under the immigration and naturalization laws if he does so. If an alien takes such action, he may be regarded as having abandoned his residence in the Unite States and as having lost his inimigrant status under the immigration and naturalization laws. A a consequence he may be ineligible for a visa or other document for which lawful permanent resident aliens are eligible; he may be inadmissible to the United States if he seeks admission as a returning resident; and he may become ineligible for naturalization on the basis of his original entry or adjustment as an immigrant.

INS ISSUES OPINION ON EFFECT OF NONRESIDENT TAX FILING ON GREEN CARD STATUS
The Office of the General Counsel of the INS has stated in a recent legal opinion that filing a non-resident tax return raises the presumption that a green card holder has abandoned his or her permanent residency status. The opinion went on to state that in most cases, an alien would be able to overcome this presumption only by presenting evidence tending to show that the alien filed the nonresident alien tax return fraudulently, an admission that could bring criminal penalties. Persons wishing to avoid US taxes on some or all of their income by filing under this category should be extremely cautious about taking such a step.
